Mobarak Mart-এ আপনাকে স্বাগতম। আমাদের ওয়েবসাইট ব্যবহার বা কোনো পণ্য ক্রয়ের পূর্বে দয়া করে নিচের শর্তাবলী (Terms and Conditions) মনোযোগ সহকারে পড়ে নেওয়ার অনুরোধ করা হলো।

এই ওয়েবসাইট ব্যবহার করার মাধ্যমে আপনি আমাদের শর্তাবলীর সাথে সম্মতি জ্ঞাপন করছেন। যদি আপনি এই শর্তাবলীতে সম্মত না হন, তবে দয়া করে আমাদের ওয়েবসাইট বা সেবা ব্যবহার থেকে বিরত থাকুন। এই শর্তাবলী আপনার এবং Mobarak Mart-এর মধ্যে একটি আইনি চুক্তি হিসেবে গণ্য হবে।

সেকশন ১: সাধারণ শর্তাবলী (প্রোডাক্ট প্রাইস এবং স্টক)

যেকোনো পণ্যের মূল্য এবং প্রাপ্যতা (Availability) সম্পূর্ণরূপে স্টকের ওপর নির্ভরশীল।

স্টক প্রাপ্যতা:
অর্ডার করার পর যদি কোনো পণ্য স্টকে না থাকে বা পরবর্তীতে Out of Stock হয়ে যায়, তাহলে আমরা যত দ্রুত সম্ভব আপনাকে অবহিত করব। এক্ষেত্রে আমরা আপনাকে সমমানের বিকল্প পণ্য অফার করতে পারি অথবা আপনার অগ্রিম পেমেন্ট থাকলে তা আমাদের Refund Policy অনুযায়ী ফেরত প্রদান করা হবে।

অর্ডার পরিবর্তন/বাতিল:
সাপ্লাই চেইন সমস্যা, প্রাকৃতিক দুর্যোগ, পরিবহন সমস্যা, সরবরাহকারীর সমস্যা বা অন্যান্য অনাকাঙ্ক্ষিত পরিস্থিতির কারণে অর্ডার কনফার্ম করার পরেও Mobarak Mart অর্ডার বাতিল বা পরিবর্তন করার অধিকার সংরক্ষণ করে।

মূল্য পরিবর্তন:
কোনো প্রকার পূর্ব নোটিশ ছাড়াই পণ্যের মূল্য পরিবর্তনের অধিকার কর্তৃপক্ষ সংরক্ষণ করে। অর্ডার করার পর কিন্তু ডেলিভারির পূর্বে মূল্য পরিবর্তন হলে প্রয়োজন অনুযায়ী আপনাকে জানানো হতে পারে। এক্ষেত্রে আপনি সংশোধিত মূল্যে অর্ডার গ্রহণ অথবা অর্ডার বাতিল করার সিদ্ধান্ত নিতে পারবেন।

সেকশন ২: প্রোডাক্ট এবং উপস্থাপনা

আমাদের পণ্যসমূহ অনলাইনে প্রদর্শন করা হয় এবং স্টক থাকা সাপেক্ষে অর্ডার করা যায়।

রঙ ও ধরণ:
আমরা সর্বোচ্চ চেষ্টা করি ওয়েবসাইটে প্রদর্শিত ছবি, পণ্যের নাম, রঙ, সাইজ ও বিবরণ যথাসম্ভব সঠিকভাবে উপস্থাপন করতে। তবে আপনার ব্যবহৃত ডিভাইসের ডিসপ্লে সেটিংস, রেজোলিউশন, আলো বা অন্যান্য প্রযুক্তিগত কারণে ছবির সাথে বাস্তব পণ্যের রঙে সামান্য পার্থক্য হতে পারে।

পণ্যের বৈশিষ্ট্য:
কোনো পণ্যের মডেল, ডিজাইন, প্যাকেজিং, রঙ বা অন্যান্য বৈশিষ্ট্য প্রস্তুতকারক বা সরবরাহকারীর পরিবর্তনের কারণে পূর্ব ঘোষণা ছাড়াই পরিবর্তিত হতে পারে।

রিটার্ন:
কোনো পণ্য ওয়েবসাইটে প্রদর্শিত বিবরণ বা নির্ধারিত শর্তের সাথে সামঞ্জস্যপূর্ণ না হলে, প্রযোজ্য ক্ষেত্রে অব্যবহৃত অবস্থায় আমাদের Return and Replacement Policy অনুযায়ী তা ফেরত বা পরিবর্তনের জন্য আবেদন করা যেতে পারে।

সেকশন ৩: বিলিং এবং একাউন্ট তথ্যের নির্ভুলতা

একটি সুষ্ঠু ও দ্রুত সেবা নিশ্চিত করার জন্য সঠিক তথ্য প্রদান করা অত্যন্ত গুরুত্বপূর্ণ।

সঠিক তথ্য:
অর্ডার প্লেস করার সময় আপনার নাম, ঠিকানা, মোবাইল নম্বর, ইমেইল ঠিকানা এবং প্রয়োজনীয় পেমেন্ট সংক্রান্ত তথ্য সঠিকভাবে প্রদান করতে হবে।

আপনার দেওয়া ভুল, অসম্পূর্ণ বা বিভ্রান্তিকর তথ্যের কারণে ডেলিভারি বিলম্বিত, ব্যর্থ বা বাতিল হলে তার দায়ভার গ্রাহককে বহন করতে হতে পারে।

অর্ডার বাতিলকরণ:
Mobarak Mart যেকোনো অর্ডার গ্রহণ, প্রত্যাখ্যান, বাতিল অথবা পণ্যের অর্ডার পরিমাণ সীমিত করার অধিকার সংরক্ষণ করে।

বিশেষ করে অস্বাভাবিক পরিমাণে অর্ডার, বাণিজ্যিক পুনঃবিক্রয় (Reselling), Dealer বা Distributor-এর ক্ষেত্রে কর্তৃপক্ষের যাচাই ও বিবেচনার ভিত্তিতে অর্ডার গ্রহণ বা বাতিল করা হতে পারে।

একাধিক একাউন্ট:
একজন গ্রাহক প্রতারণামূলকভাবে একাধিক অ্যাকাউন্ট ব্যবহার করে একই অফার, কুপন বা ডিসকাউন্ট নেওয়ার চেষ্টা করতে পারবেন না।

একাধিক অ্যাকাউন্ট ব্যবহার করে কোনো অফার বা ডিসকাউন্টের অপব্যবহার শনাক্ত হলে অর্ডার বাতিল, অফার বাতিল অথবা সংশ্লিষ্ট অ্যাকাউন্ট স্থগিত করা হতে পারে।

সেকশন ৪: ডিসকাউন্ট এবং অফার

ব্যবহার:
Coupon Code, Promo Code, Discount অথবা Special Offer শুধুমাত্র নির্দিষ্ট সময়ের জন্য এবং নির্দিষ্ট শর্তসাপেক্ষে প্রযোজ্য হবে।

সীমাবদ্ধতা:
একটি নির্দিষ্ট অফার বা ডিসকাউন্ট একজন গ্রাহক একবার বা অফারে উল্লেখিত সীমা অনুযায়ী ব্যবহার করতে পারবেন।

একাধিক অ্যাকাউন্ট, ভুয়া তথ্য বা অন্য কোনো অননুমোদিত পদ্ধতি ব্যবহার করে অফার গ্রহণের চেষ্টা করা হলে অর্ডার বাতিল করা হতে পারে।

রিফান্ড ও এক্সচেঞ্জ:
ডিসকাউন্ট বা বিশেষ অফারের আওতায় ক্রয় করা পণ্যের ক্ষেত্রে Refund বা Exchange প্রযোজ্য নাও হতে পারে, যদি না পণ্যটি ত্রুটিপূর্ণ, ভুল পণ্য বা আমাদের পক্ষ থেকে ভুলভাবে সরবরাহ করা হয়ে থাকে।

অধিকার:
Mobarak Mart কোনো প্রকার পূর্ব ঘোষণা ছাড়াই যেকোনো অফার, কুপন, ডিসকাউন্ট বা প্রচারণামূলক কার্যক্রম পরিবর্তন, স্থগিত, সীমিত বা বাতিল করার অধিকার সংরক্ষণ করে।

সেকশন ৫: থার্ড-পার্টি লিংক বা সেবা

আমাদের ওয়েবসাইটে সেবার প্রয়োজনে কিছু Third-Party Link, Payment Service, Delivery Service অথবা অন্যান্য তৃতীয় পক্ষের সেবা থাকতে পারে।

দায়বদ্ধতা:
কোনো Third-Party Website বা Service ব্যবহার করলে সংশ্লিষ্ট সেবার শর্তাবলী ও Privacy Policy প্রযোজ্য হবে।

তৃতীয় পক্ষের সেবা ব্যবহারের ফলে কোনো ক্ষতি, বিলম্ব, ত্রুটি বা অসুবিধার জন্য Mobarak Mart সরাসরি দায়ী থাকবে না, যদি সেই বিষয়টি আমাদের নিয়ন্ত্রণের বাইরে থাকে।

সেকশন ৬: ভুল তথ্য এবং ত্রুটি সংশোধন

আমাদের ওয়েবসাইটে অনিচ্ছাকৃতভাবে Typing Error, Product Information Error, Price Discrepancy, Stock Error বা অন্যান্য ভুল তথ্য থাকতে পারে।

সংশোধন:
Mobarak Mart যেকোনো সময় কোনো ভুল, অসম্পূর্ণ বা বিভ্রান্তিকর তথ্য সংশোধন, পরিবর্তন বা আপডেট করার অধিকার রাখে।

অস্বাভাবিক মূল্য:
সিস্টেম বা প্রযুক্তিগত ত্রুটির কারণে যদি কোনো পণ্যের মূল্য অস্বাভাবিকভাবে কম প্রদর্শিত হয়—যেমন ১,২০০ টাকার পণ্য ভুলবশত ১২ টাকায় প্রদর্শিত হওয়া—তাহলে আমরা অর্ডারটি বাতিল করার অধিকার সংরক্ষণ করি।

এক্ষেত্রে গ্রাহক ইতোমধ্যে পেমেন্ট করে থাকলে প্রযোজ্য Refund Policy অনুযায়ী অর্থ ফেরত দেওয়ার ব্যবস্থা করা হবে।

সেকশন ৭: অর্ডার বাতিলকরণ (কর্তৃপক্ষ দ্বারা)

আমরা গ্রাহকদের জন্য যথাসম্ভব মানসম্মত ও সঠিক পণ্য সরবরাহ করার চেষ্টা করি।

কোয়ালিটি চেক:
শিপিংয়ের আগে পণ্য যাচাইয়ের সময় কোনো ত্রুটি ধরা পড়লে, পণ্যটি ক্ষতিগ্রস্ত হলে অথবা পণ্যটি বিক্রয়যোগ্য অবস্থায় না থাকলে অর্ডারটি বাতিল করা হতে পারে।

ইনভেন্টরি সমস্যা:
Technical Error, Inventory Synchronization সমস্যা অথবা Stock Update-এর বিলম্বের কারণে কোনো পণ্য স্টকে না থাকা সত্ত্বেও অর্ডার প্লেস হতে পারে।

এ ধরনের পরিস্থিতিতে Mobarak Mart অর্ডারটি বাতিল করতে পারে এবং গ্রাহক অগ্রিম পেমেন্ট করে থাকলে প্রযোজ্য Refund Policy অনুযায়ী রিফান্ডের ব্যবস্থা করা হবে।

সেকশন ৮: নিষিদ্ধ ব্যবহার (Prohibited Uses)

আমাদের ওয়েবসাইট বা সার্ভিস ব্যবহার করে নিম্নলিখিত কাজগুলো করা সম্পূর্ণ নিষিদ্ধ:

• (ক) কোনো অনৈতিক, প্রতারণামূলক বা বেআইনি কাজে ওয়েবসাইট ব্যবহার করা।

• (খ) কোনো স্থানীয়, জাতীয় বা আন্তর্জাতিক আইন ও বিধিমালা লঙ্ঘন করা।

• (গ) মেধা সম্পত্তি (Intellectual Property), Trademark, Copyright বা অন্যান্য মালিকানাধীন অধিকার লঙ্ঘন করা।

• (ঘ) কোনো ব্যক্তি বা প্রতিষ্ঠানের বিরুদ্ধে হয়রানি, হুমকি, অপমান বা বৈষম্যমূলক আচরণ করা।

• (ঙ) ভুল, মিথ্যা বা বিভ্রান্তিকর তথ্য প্রদান করা।

• (চ) Virus, Malware বা Malicious Code আপলোড বা ছড়ানো যা আমাদের ওয়েবসাইট, সার্ভার বা ব্যবহারকারীদের ক্ষতি করতে পারে।

• (ছ) অন্যের ব্যক্তিগত তথ্য সংগ্রহ, চুরি বা অপব্যবহার করা।

• (জ) Spam, Phishing বা অন্য কোনো প্রতারণামূলক কার্যক্রম পরিচালনা করা।

• (ঝ) ওয়েবসাইটের নিরাপত্তা ব্যবস্থা, সার্ভার বা স্বাভাবিক কার্যক্রমে হস্তক্ষেপ করা।

• (ঞ) অনুমতি ছাড়া ওয়েবসাইটের কোনো অংশ কপি, পরিবর্তন, পুনরুৎপাদন বা বাণিজ্যিকভাবে ব্যবহার করা।

• (ট) স্বয়ংক্রিয় সফটওয়্যার, Bot বা অন্য কোনো পদ্ধতির মাধ্যমে ওয়েবসাইটের কার্যক্রমে অননুমোদিত হস্তক্ষেপ করা।

দ্রষ্টব্য:
এই শর্তাবলীর কোনো অংশ লঙ্ঘন করলে Mobarak Mart আপনার অ্যাকাউন্ট, অর্ডার বা নির্দিষ্ট সেবা কোনো পূর্ব নোটিশ ছাড়াই স্থগিত বা বাতিল করার অধিকার সংরক্ষণ করে।

Mobarak Mart reserves the right to accept, reject, cancel, or limit the quantity of any order.

Orders involving unusually large quantities, commercial reselling, dealers, or distributors may be subject to additional verification and may be canceled at our discretion.

Multiple Accounts:
Customers may not use multiple accounts fraudulently to obtain the same offer, coupon, or discount more than permitted.

If misuse of promotional offers through multiple accounts is detected, the order may be canceled and the relevant account or promotional benefit may be suspended.

Usage:

Limitations:

Rights:

Abnormal Price:
If a product is displayed at an unusually low price due to a technical or system error—for example, a product worth BDT 1,200 being displayed at BDT 12—we reserve the right to cancel the order.

If payment has already been made, the amount will be refunded according to our applicable Refund Policy.

Section 7: Order Cancellation by Authority

We make reasonable efforts to provide customers with genuine and quality products.

Quality Check:
If a defect is identified during the quality check before shipping, if the product is damaged, or if the product is deemed unsuitable for sale, the order may be canceled.

Inventory Issues:
Due to technical errors, inventory synchronization problems, or delayed stock updates, an order may occasionally be placed for a product that is no longer available.

In such cases, Mobarak Mart may cancel the order. If advance payment has already been made, a refund will be processed according to our Refund Policy.
